Is a Driveway Drainage Channel Required in 2026?
For most solid driveways in the UK, the practical answer is yes. Since October 2008, a non-permeable driveway over 5m² that drains onto the public highway needs planning permission. To avoid that, the rainwater must be managed on your own property — which in practice means either a permeable surface or a drainage channel feeding a soakaway. Do you need a driveway drainage channel?
- Yes, for a solid (impermeable) driveway over 5m² — you must stop water running onto the road, so a channel to a soakaway is the usual solution.
- No law names the channel itself — the legal trigger is the 5m² + impermeable + drains-to-highway combination, which needs planning permission unless you manage runoff on-site.
- Not usually needed for permeable surfaces — porous resin, gravel or permeable block paving on the correct sub-base let water soak away.
- Building it in is far cheaper than retrofitting — a channel + soakaway adds £800–£2,000 to a new driveway but thousands if added later.
The 5m² rule and SuDS, explained
Since October 2008, planning rules in England changed to reduce surface-water flooding from paved front gardens. The key test has three parts — all three must be true to trigger the need for planning permission.
1️⃣ Over 5m²
The new or replacement hard surface is larger than five square metres.
2️⃣ Impermeable
The surface does not let water soak through — e.g. standard concrete, tarmac or non-permeable block paving.
3️⃣ Drains to the road
Rainwater runs off onto the public highway rather than soaking away within your property.
If all three are true, you need planning permission. Avoid any one of them — keep it under 5m², use a permeable surface, or direct the water to a soakaway on your land — and the work stays permitted development. For a solid driveway that you do not want to shrink, the realistic route is a drainage channel feeding a soakaway.
Three compliant ways to drain a driveway
A linear channel (often called an ACO-style channel) sits across the low edge of the drive and collects runoff into a pipe that feeds a soakaway. The soakaway must be sized for your area and ground conditions — heavy clay needs a larger soakaway or attenuation crates.

SuDS, building regulations and sizing your soakaway
The planning trigger is only half the picture. Even where your driveway stays within permitted development, the drainage still has to cope with a 2026 climate of heavier, more concentrated downpours. Building a soakaway that is too small is the most common reason a compliant-on-paper driveway still floods in a storm, so it pays to size it for your ground conditions rather than guessing.
How a soakaway is sized
A domestic soakaway is normally sized using a percolation test and the BRE Digest 365 method: you dig a test pit, measure how quickly water drains away, and size the crate volume to hold the runoff from a heavy storm. Free-draining sandy or gravel soils need only a modest soakaway; heavy clay drains slowly and needs a larger pit, more attenuation crates, or a slow-release outfall. As a rule of thumb an installer allows storage for the rainfall landing on the paved area during a one-in-ten-year storm, plus a safety margin.
When you also need approval
Most front-driveway soakaways are permitted development and do not need a separate building regulations application, but a soakaway should sit at least five metres from any building and clear of the highway. If runoff is instead sent to a public surface-water sewer, the water company’s approval is required and is not guaranteed.
